Terms: No Buyers Premium. The buyer shall pay 5% nonrefundable earnest money down of total purchase amount on the day of the auction in the form of a check, cashiers check or U.S. currency and enter into a non-contingent purchase agreement with the balance to be paid upon closing on or before 60 days. Winning bidder will enter into the purchase agreement day of sale. Said purchase agreement will contain the following term:
The property sold herein is subject to a Right of First Refusal (ROFR) in which the optionee in the ROFR has 15 days after receipt of notice of this purchase agreement to exercise his option. This purchase agreement shall be cancelled if said optionee exercises his ROFR, and any and all rights and obligations herein this purchase agreement shall forever terminate. The Earnest Money shall immediately be returned to the Buyer. Further, the parties shall immediately sign a Cancellation of Purchase Agreement. If a party does not timely sign said cancellation, the other party may obtain a judicial cancellation of the Purchase Agreement and all costs, including any and all attorney’s fees, shall be the responsibility of the party that does not timely sign said cancellation. Further, if the ROFR is exercised, the Seller shall reimburse the Buyer herein for any out-of-pocket costs, incurred after the auction, by Buyer due to his/her planned purchase hereunder. Interest incurred on the Buyer’s earnest money during the option period shall not be an eligible out-of-pocket expense of Buyer.
The property will be sold in “AS IS” condition. Buyer to get possession for the 2024 crop year. Subject to any easements of record. The seller or seller’s agents are not responsible for any errors in information. This is a guide. Buyers are responsible to collect their own info. Online bidders are required to mail in a $30,000 earnest money check or cashiers check made out to Mages Land Company Trust. Checks will be held, and not deposited.
